Secure MT – Terms of Use

Welcome to Secure MT, a secure and flexible online payment platform operated by Secure MT Ltd (“we”, “us”, “our”). These Terms of Use (“Terms”) govern your access to and use of Secure MT’s services, including card payment processing, digital wallets (e.g. Apple Pay, Google Pay), and instant bank payments via open banking. By registering for or using Secure MT, you agree to be bound by these Terms.

By accessing or using Secure MT, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. These Terms form a legally binding agreement between you and Secure MT LTD.

If you do not agree to these Terms, you must not use the service.

1. About Secure MT

Secure MT is a digital payment gateway designed for businesses, offering:

  • Card payment processing (Visa, Mastercard, etc.)
  • Digital wallet support (Apple Pay, Google Pay)
  • Open banking payments (UK banks via secure APIs)
  • Secure payouts to merchant bank accounts
  • Real-time transaction monitoring and fraud checks

Our service allows merchants to accept and manage online payments through an integrated, secure platform.

2. Eligibility

To use Secure MT, you must:

  • Be a legally registered business entity
  • Be located in the United Kingdom or another approved territory
  • Provide accurate onboarding documentation (e.g. KYC/KYB)

We reserve the right to refuse service to any applicant that does not meet our risk, compliance, or legal requirements.

3. Account Creation & Access

You must create a business account to access Secure MT services. You agree to:

  • Maintain accurate business, banking, and contact details
  • Keep your login credentials, API keys, and payment tokens secure
  • Notify us immediately of any unauthorised access or suspected breach

You are fully responsible for all activity under your account unless you notify us of unauthorised use.

4. Regulatory Compliance

Secure MT is operated in compliance with applicable UK financial regulations, including:

  • Financial Conduct Authority (FCA) standards (where applicable)
  • UK Payment Services Regulations 2017
  • Open Banking compliance via secure licensed integrations

Merchants must not use Secure MT for illegal, high-risk, or unlicensed activities, including but not limited to:

  • Adult content
  • Gambling
  • Counterfeit goods
  • Money laundering
  • Unlicensed pharmaceuticals

We may request enhanced due diligence for high-risk industries.

5. Payment Processing

5.1 Supported Methods

Secure MT supports:

  • Credit and debit cards
  • Apple Pay and Google Pay
  • Instant payments through UK open banking APIs

5.2 Transaction Approval

We reserve the right to decline transactions that are flagged as suspicious, exceed limits, or violate our Acceptable Use Policy.

5.3 Settlement & Payouts

Funds are typically settled to your nominated bank account within [1–5] business days, depending on method and risk level. Payout schedules may be modified based on risk review, transaction volume, or policy violations.

6. Fees & Billing

Secure MT charges fees per transaction or based on monthly usage, as outlined in your service agreement. You agree to:

  • Pay all applicable processing, platform, and payout fees
  • Allow Secure MT to deduct fees from your balance or linked account
  • Raise billing disputes within 14 days of the statement issue

Late or disputed payments may result in suspension or account review.

7. Security & Data Protection

We use:

  • End-to-end encryption
  • PCI-DSS compliant systems
  • Secure tokenisation
  • Real-time fraud detection and authentication

You must also take appropriate security steps, such as:

  • Implementing HTTPS on your website
  • Complying with PCI-DSS if storing customer card data
  • Not storing cardholder data unless explicitly approved

8. Data Collection & Privacy

We collect and process:

  • Transaction data (amount, timestamp, method)
  • Customer metadata (IP address, device/browser info)
  • Business information for compliance

You agree to inform your customers of the payment data processing in your own Privacy Policy.

9. Chargebacks & Disputes

If a customer disputes a transaction, you may be responsible for chargebacks, penalties, or reversals.

You agree to:

  • Respond to chargeback notices within the required timeframe
  • Provide accurate supporting documentation
  • Accept responsibility for unresolved disputes or fraudulent transactions

We may deduct chargeback amounts from your balance or future settlements.

10. Service Limitations & Availability

Secure MT is provided “as is” and “as available.” We do not guarantee uninterrupted service and are not liable for delays or outages caused by:

  • Banking networks
  • Card scheme outages
  • Third-party wallet systems (e.g., Apple or Google Pay)
  • Internet service providers
  • Scheduled maintenance or force majeure
  •  

We will provide notice of scheduled downtime when feasible.

11. Suspension & Termination

We may suspend or terminate your access if:

  • You breach these Terms
  • You engage in fraudulent or prohibited activities
  • You violate payment network rules
  • You fail to comply with our onboarding or KYC/KYB requests

Upon termination, pending payouts may be held for a reasonable time to cover potential chargebacks or investigations.

12. Intellectual Property

Copyright, trademark, and intellectual property laws protect all Secure MT software, branding, and APIs. You may not:

  • Copy, reverse engineer, or resell our services
  • Use Secure MT’s branding without permission

13. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, special, or consequential losses
  • We are not responsible for your customers’ failure to complete payments
  • Our liability is limited to the total fees paid by you in the 3 months before the claim

14. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales, unless otherwise required by applicable law.
